 1. Definitions

In these terms and conditions, the following terms are defined:

  1. “Sett Scape” means E Fitroy & J.M McCarthy, 97 884 673 411 their sub-contractors, agents and authorised employees. 

  2. “Customer” means the person, company or agent on the tax invoice hiring the equipment from “Sett Scape”. 

  3. “Tableware” means the goods hired as they appear on the tax invoice, for the function, event, or purpose, for which the goods are to be used. This includes tablecloths, dinner plates, side plates, cutlery (forks, knives, spoons), napkins, water glasses, cocktail glasses, vases, candles, candle holders, personalised menus, and flowers. 

  4. “Agreement” means the hire agreement or hire contract / tax invoice between Sett Scape and the Customer of Sett Scape, who hires the Tableware.

  5. “Charges” means the fees/money payable by the Customer to Sett Scape for the Tableware in accordance with the Agreement. 

2. Agreement

Sett Scape will provide the Agreement for the hire goods, which the Customer or their agent will sign prior to, or upon receipt of the Tableware and pay the total invoice amount if prepayment has not been made. 

By making payment for the Tableware, the Customer agrees to have read, understood, and be bound by these Terms and Conditions.

3. Fees and Charges

The Customer agrees to pay the rental fee as specified in the invoice provided by Sett Scape. 

4. Payment

A refundable security deposit may be required and will be returned to the Customer after the Tableware is returned in the same condition as when rented.

A 30% deposit is required to secure the Tableware for the date specified by the Customer. 

Failure to receive payment of deposit within the 7 days after an invoice is issued, may result in Sett Scape not providing the Tableware on the Customer’s preferred date and time. 

Payment is due in full 14 days before the booking date or if agreed upon prior to delivery or collection of the Tableware. Sett Scape reserves the right to withhold the deposit if payment has not been received prior to delivery. 

An extra delivery charge will apply should Sett Scape have the need to redeliver as a result of non-payment on delivery. 

5. Delivery, Setup and Collection

Hiring the Tableware from Sett Scape does not include setup or styling. If you would like Sett Scape to setup and style your event, there will be an additional cost of $180 for delivery, set up and collection of the Tableware.  

Sett Scape can arrange for delivery and collection of the Tableware within a 25km radius of Fremantle at a further cost of $50.00.

If Sett Scape is delivery and collecting from the Customer, the Customer is to confirm the date and time of when the products are to be delivered and picked up and the Customer is responsible for ensuring that they are present and available at the specified location to accept and return the Tableware.

Sett Scape will require a 15% damage bond to be paid. The tableware must be returned in the same condition as when rented. Any damages (chips or breaks), missing or stained items, Sett Scape will keep the damage bond and if the damages are greater than the bond received, a separate invoice will be sent to the Customer and payment will be required 7 days after the invoice has been issued. 

Once all Tableware have been inspected by Sett Scape, the bond will be returned to the Customer within 5 days after your event. 

Sett Scape can refuse to deliver hired items if they believe it is unsafe to do so. 

6. Set up of Tableware

Sett Scape will endeavor to take every care when delivering, setting up, and collecting the Tableware, it shall not be liable for any damage or loss to the site, site access or plants and the Customer shall indemnify Sett Scape from and against all actions, claims, costs, demands and liabilities in connection there with. 

If the Customer is collecting and setting up the Tableware, they will endeavor to take every care when delivering, setting up, and collecting the Tableware. 

No Tableware is not to be removed from the delivery location unless prior approval by Sett Scape. 

7. Inspection

Sett Scape ensures all Tableware is thoroughly checked, counted and cleaned prior to delivery. 

It is the Hirers responsibility to check all the ordered Tableware upon delivery and notify the Sett Scape of any breakages or missing items within 2 hours of receiving the Tableware. 

The Customer acknowledges that it is aware of the proper use for which the Tableware is designed, has inspected the Tableware, and expressly agrees that the Tableware is:

a) in a clean condition and useable condition;

b) fit for purpose; and

c) of the correct quantity as ordered.

8. Use of Tableware

The Customer is responsible for using the Tableware with reasonable care and in accordance with its intended purpose.

9. Ownership

The Tableware supplied by Sett Scape and remains the property of Sett Scape. 

10. Cancellation and Postponement

If the Customer cancels or postpones the Agreement prior to the commencement of the stated delivery date, then Sett Scape reserves the right to keep any deposit paid. 

11. Loss, Damage and Cleaning

The Customer accepts full responsibility to compensate Sett Scape for the value of the Tableware, or parts thereof which may be lost, stolen, damaged or broken during the hire period. 

Sett Scape request is that all glassware must be devoid of any liquid and all food to be taken off the plates and rinsed. The cutlery must be rinsed, dried and place in the linen bag provided. DO NOT place any of our items in a dishwasher, leave the main cleaning up to us including all the linen. 

If upon the return of the Tableware, Sett Scape finds the equipment to be mishandled or not in satisfactory working condition, the Customer shall pay to Sett Scape the cost and expenses of cleaning and restoring the Tableware to good working order. 

Any resulting additional costs, including reasonably incurred legal costs by Sett Scape, shall be paid by the Customer. 

12. Insurance

The Customer is responsible for insurances during the hire period. The Customer is responsible for the security of the Tableware at all times during the hire period. Any lost, broken, damaged or destroyed Tableware will be charged to Customer, at full replacement value.

14. Liability to third parties

The Customer hereby indemnifies and holds indemnified Sett Scape from and against all claims, actions, suits, demands and expenses in any way arising from injury, death, loss of income or damage caused to the hirer or its property, or any other third parties or property, in respect of the Tableware hired.

15. Acceptance of Terms & Conditions

By paying deposit Customer hereby unconditionally accepts the above terms and conditions and acknowledges that its acceptance is a condition precedent to taking possession of the Tableware from Sett Scape.

16. Governing law

This Agreement will be construed in accordance with and governed by the laws of Western Australia. Each party submits to the non-exclusive jurisdiction of the courts of Western Australia in connection with matters concerning this Agreement.
